1Acceptance of terms

These terms govern your use of the Modern Surgicals website and any purchase made from us. By browsing the site, sending an enquiry or placing an order you agree to these terms. If you do not agree, please do not use the site.

2Use of the website

You agree to use the site only for lawful purposes and in a way that does not harm the site or other users. You must not:

• Attempt to gain unauthorised access to the site or its systems.
• Copy, scrape or reuse our content, images or trademarks without written permission.
• Submit false, misleading or fraudulent information.

MSC® and the MSC logo are registered trademarks. All content on the site is owned by or licensed to us.

3Products and availability

We make every effort to show accurate descriptions, specifications and images, but small variations in colour, finish or packaging may occur. Products are subject to availability, and we may limit quantities or discontinue items without notice. Our instruments are intended for use by qualified healthcare professionals.

4Pricing and GST

Prices are shown in Indian Rupees (INR) and may change without notice. Unless stated otherwise, prices are exclusive of applicable GST and shipping, which are added at checkout or on the invoice. Bulk and institutional pricing is provided through written quotations and is valid for the period stated on the quotation.

Please provide a valid GSTIN to receive a GST invoice with input tax credit.

5Orders and acceptance

Placing an order is an offer to buy. A contract is formed only when we confirm the order by email, phone or WhatsApp, or dispatch the goods. We may decline or cancel any order, for example because of stock shortage, pricing errors or suspected fraud, in which case any payment made will be refunded.

6Payments

Payment must be made using the methods offered at checkout or stated on the quotation. For institutional customers, credit terms may be agreed in writing. Delayed payments may attract interest and a hold on further supplies.

7Shipping and returns

Delivery and returns are governed by our Shipping & Returns policy, which forms part of these terms.

8Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from the use of the site or our products, or for delays caused by events beyond our control. Our total liability for any claim is limited to the price paid for the products concerned. Nothing in these terms excludes liability that cannot be excluded by law.

9Governing law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Delhi.

10Changes to these terms

We may update these terms from time to time. The version published on this page, with its “last updated” date, applies to your use of the site.
